Enjoywinter Sweepstakes Official Rules: NO PURCHASE NECESSARY TO ENTER OR WIN.

1. Eligibility: The Enjoywinter Sweepstakes 2007 (“Sweepstakes” or “Promotion”) is offered in and open only to legal residents of the 48 contiguous United States and District of Columbia (“U.S.”) age 18 and older. Minors under the age of 18 must obtain the consent of their parent or legal guardian in order to enter the contest.
2. Sweepstakes Period: Sweepstakes begins on November 1, 2007 at 12:00:01 a.m. Eastern Time (ET) and ends on April 30, 2008 at 11:59:59 p.m. (ET). The Sweepstakes computer is the official time keeping device for the Sweepstakes.
3. To Participate: Access www.enjoywinter.com (“web site”) and click on the Sweepstakes icon, banner or text link to be taken to the Sweepstakes registration page. On that page provide the required information, specifically your name and email address and click on the “Submit” button. When your entry is received and recorded by the Sweepstakes computer you will receive one entry into the Sweepstakes. Limit one direct entry per person. Any attempt by any participant to obtain more than one (1) entry using multiple/different email addresses, identities or any other methods will void that participant’s entries and that participant. Increase your entries by inviting your friends to enter the Sweepstakes. Your name will be entered again for each one of your friends, up to 100, who accept your invitation Entries and Invite acceptance must be received and recorded by 11:59:59 p.m. ET on April  30, 2008.
4. Drawing: Winner will be selected in a random drawing held on/about  5/1/08 from all eligible entries received. Winner will be notified by email only. Winner will be required to complete, sign and return within a specified time an Affidavit of Eligibility, a Liability Release and, where lawful, a Publicity Release. If document is not timely returned or if a prize notification is returned as non-deliverable, prize will be forfeited and awarded to an alternate. If winner is a minor in his/her jurisdiction of residence, prize may be awarded in the name of, or to, winner’s parent/legal guardian who must execute all documents and agree to all obligations and undertakings of winner, both on behalf of winner and himself/herself, or prize may be forfeited and awarded to an alternate.
5. Prize/Odds: (1) Grand Prize is a Yakima Sky Box 21 Pro FILLED with Factory Team Sponsors' products. Visit www.enjoywinter.com/sponsors.htm for prize list. Prize will be shipped within the continental United States via freight. Winner must pick up prize with 7 days of notification that Prize is available, or prize may be forfeited, and an alternate winner selected. Winner does not have choice of any prize substitutions. Actual prizes may differ from that shown in advertisements. Taxes and expenses not stated related to acceptance and use of prize are solely the responsibility of the winner.  An IRS Form 1099 for the fair market value of the prize will be filed and a copy provided to winner. Any difference between the stated and actual value of prize will not be awarded. Odds of winning depend on the number of eligible entries received.
6. General Conditions: By participating, Participants (and participant’s parent/legal guardian, if participant is a minor) agree (a) to these Official Rules and the decisions of the Sponsor which decisions shall be final;(b) that Sponsor, Endurance Enterprises Inc. and its Factory Team, its respective parents, subsidiaries, sponsors and affiliated companies, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents (collectively “Releasees”) are released, will have no liability whatsoever for, and shall be held harmless by participants (and a participant’s parent/legal guardian, if participant is a minor) against any liability for any injuries, losses or damages of any kind to person(s), including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, or use of the prize or participation in this Sweepstakes and (c) except where legally prohibited, winner (and winner’s parent/legal guardian, if winner is minor) grant (and agree to confirm that grant in writing) permission to Sponsor and those acting under its authority the right to the use of his/her name, picture, likeness, voice, biographical information and statements, at any time or times, for advertising, trade, publicity and promotional purposes without additional compensation, in all media now known or hereafter discovered, worldwide and on the Internet and World Wide Web, without notice, review or approval; and (d) that no representation or warranty, written or oral, express or implied, in law or in fact is made for the grand  prize.
7. Liability Limitations: Releasees are not responsible for lost, late, misdirected, incomplete, or non-delivered entries or email; or for interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), web site, telephone or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, corrupted, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information. Persons who tamper with or abuse any aspect of this Sweepstakes, as solely determined by the Sponsor, will be disqualified. Any use of robotic, automatic, macro, programmed or like entry methods will void all such entries by such methods, and disqualify any entrant using such methods. Releasees are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the web site. Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention, technical failures or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to cancel or terminate the Sweepstakes, and select the winner from entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor; and notice thereof will be posted on the web site. Releasees are not responsible for any incorrect or inaccurate information, however caused. In case of dispute, the authorized subscriber of the email account used to enter the Sweepstakes at the actual time of entry will be deemed to be the participant who must comply with these Official Rules.  IN NO EVENT WILL RELEASEES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE WEB SITE OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID WEB SITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THIS WEB SITE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. 8. All original email addresses obtained will be automatically subscribed to SkiPost.  Anyone entered to win the raffle must remain subscribed to SkiPost for the duration of the enjoywinter sweepstakes to be eligible to win.
9. Dispute Resolution/Arbitration/Choice of Law: Except where prohibited, entrants (and each entrant’s parent/legal guardian if entrant is a minor) agree that: (1) any and all disputes, claims, and causes of action arising out of or connected with this promotion, or any prize awarded, or the determination of the winners, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the Rules of the American Arbitration Association, then effective, and (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this promotion but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and/or Sponsor in connection with the promotion, shall be governed by, and construed in accordance with the laws of the State of Montana, without regard for the conflicts of law doctrine of that State or any other jurisdiction, and all proceedings shall take place in the Gallatin County and State of Montana.
